Abstract
The high number of pedestrian deaths in Colombia highlights the state's failure to guarantee quality public services in terms of road safety. This problem has remained constant over time, normalizing a situation that should generate an urgent response from society and institutions. Statistics for the period 2013-2023 show no significant reduction in the number of pedestrian deaths, indicating a lack of effective action to address the causes of the problem.
From a constitutional and legal point of view, this situation is unjustifiable, as the Colombian legal system has clear rules aimed at protecting pedestrians as particularly vulnerable users of the road system. Consequently, the problem does not lie in the absence of regulation, but in the insufficient enforcement and control of constitutional and legal mandates that impose on the State and private individuals the duty to guarantee the safety and integrity of pedestrians.
This situation allows us to infer two possible explanations: either the authorities are unaware of their obligations towards pedestrians, or there is a lack of effective control mechanisms to ensure compliance with their duty to protect them.

El elevado número de muertes de peatones en Colombia pone en evidencia la deficiente garantía de un servicio público de calidad en materia de seguridad vial por parte del Estado. Esta problemática se ha mantenido de forma constante a lo largo del tiempo, normalizando una situación que debería generar una respuesta urgente desde lo social y lo institucional. Las estadísticas del período 2013-2023 muestran la ausencia de una reducción significativa en las cifras de peatones fallecidos, lo que indica una falta de acciones eficaces para enfrentar las causas del problema.
Desde el punto de vista constitucional y legal, este escenario resulta injustificable, ya que el ordenamiento jurídico colombiano contempla normas claras orientadas a la protección del peatón como sujeto especialmente vulnerable dentro del sistema vial. En consecuencia, el problema no radica en la inexistencia de regulación, sino en la insuficiente aplicación y control de los mandatos constitucionales y legales que imponen al Estado y a los particulares el deber de garantizar la seguridad y la integridad de los peatones.
Esta situación permite inferir dos posibles explicaciones: un desconocimiento por parte de las autoridades sobre sus obligaciones frente al peatón o la ausencia de mecanismos de control efectivos que aseguren el cumplimiento de los deberes de protección.
