Un mito o una realidad del sistema penal para adolescentes en ColombiaRodriguez-Sierra, Manuel Alejandro; Otálvaro Simijaca, Wuendy JohannaThis article reflects on and promotes critical thinking about the Criminal Responsibility System for Adolescents (SRPA) in Colombia. From the observation of the resocializing pedagogical component implemented within the educational centers of the (SRPA) and the different variables on which its execution depends, such as: The analysis of law 1098 of 2006 (Code of Childhood and Adolescence), current juvenile criminal legislation in Colombia, The work model provided by the Colombian Institute of Family Welfare (ICBF) for the care of young people in conflict, and other determining factors in the positive reintegration of juvenile offenders, recognizing in this document the limitations and intrinsic drawbacks of compliance with the sanction. In addition, the disjunctive phenomenon of chronological compliance with a sanctioning ruling and the principle of reestablishing rights are raised, with the purpose of resocializing it. Exposing through 4 this analysis a critical appreciation of the high rate of recidivism present in the Criminal Responsibility System for Adolescents and the efforts implemented in the system. In conclusion, the priority urgency is established to implement new attention mechanisms and the rethinking of pedagogical perspectives within the (SRPA) that are integrated with training projects adapted to current realities, which aim to transform the social reality of the minor offender , through the adaptation of profiles and characterizations that respond to the social, personal and family needs of the adolescent and their environment.
